The fact that they do it in a way that is very favorable to the artists is a reflection of the imbalance in who stands to gain from that relationship. Dave Grohl gets jack shit when you take a picture of him, he's already maximum famous. You could make a bunch of money off a picture of him or raise your professional profile, should he just let you do it? (I guess I sort of pictured Dave Grohl as the kind of guy that would just let you do it, but apparently not.)
I get why they do it, they have the power in the relationship and why not fuck over the laws that (surprisingly) benefit photographers.
I would argue that the correct way to handle a situation where you want control over the images is to hire a full-time photographer. That means issuing a salary, time off, health benefits. That's what normal companies do in this situation. By default the copyright of code I write at work belongs to me. But I have a company that I work for, so of course it goes to them. This is a beneficial relationship for us both because I can take a day off to discuss terrible behavior by metal bands and get paid for it, heh. To me, the greed isn't just that Taylor Swift or whoever can't bear to live in a world where some poor slob made money in his profession, it's the greed that god forbid her company acts as is expected by companies bringing in millions and hires some staff.
To be honest, I didn't do any investigation myself when it comes to the acts I mentioned. You are right, Grohl seems like the last guy who would give a shit. So I shouldn't possibly slander anyone without having all the facts myself. |
