The agreement requires submitting claims to the American Arbitration Association who will then provide a list of arbitrators that both parties get to "rank" our preferences, which sounded a lot shadier than the usual veto option. The only upside is the employer paying for arbitration filing.
But isn't arbitration set up by design to favor the employer? Not only is there the complete lack of appeal and oversight (besides the FREE MARKET!) but you're not entitled to shared information like a court case and the employer has all the information.
Personally, I feel it's ALWAYS time to shop around for a new job, whether or not you plan to quit in the near future. The entire point of a corporation is to protect its human creator from liability. By definition it's stupid to put rely on such an entity to have your back. Even government pensions may not have the guaranteed security that people once believed them to have in Post-Scott-Walker-America. Always have an escape tunnel dug and ready and they won't be able to put you through nearly as much shit as if they could take your services for granted.
Well yeah IDEALLY we'd all invent our own railroad super alloy and be in top demand, but I was wondering if this is usually the big red flag to jump ship and let them fire me without signing. I have a feeling I'm already on the list when I asked for my time to read this over (3 days notice till deadline!) instead of signing on the spot like everyone else. Who knows how much protection I have as an official "at will" employee. |
