Either someone was lying then or this involves some different subset of the rights.

Actually, looking at the history of Volition releasing the source code to the Free Space 2 Engine, it looks like Interplay already had the brand rights. I'm not really sure what Interplay actually acquired in this deal, but my money is on the source code to Freespace 1.
