It's been said that programmers are professionals in high demand, so there is absolutely no reason to sign non-compete clauses, or mandatory arbitration clauses, or other garbage. If you're any good, you can usually name your own ticket, so leave the mediocre companies who have to demand these things to the mediocre talent that demand them.
I've heard of one company pulling a bait-and-switch sort of thing, a guy accepts a position, sells his house, moves all the way across the country, then the company informs him, now that he's on the hook for thousands of dollars and has to be employed, that he has to sign a non-compete agreement.
I heard one company wanted to impose a non-compete agreement or arbitration clause on its programming staff, and they basically all balked.
My understanding is the way arbitration is set up it's appropriate in commercial settings, where there is an equality of the parties. An employer, by being the only customer of your labor, holds an enormous advantage, and because a lot of people do not have the funds to withstand long-term unemployment if they have a problem.
If you're a superstar or very good you can usually get individualized agreements and better terms, but often the really good people don't realize the bargaining power they have or realize they should use it. |
