They were also vetted and approved by the congress, which was elected by the people, including those in South Dakota.

Anyway, we're not talking about a democracy where every decision is left to the (whim of the) people. We're talking about the USA, which takes its governmental structure from the constitution, which provides for a Supreme Court, which has the power to act against the alleged will of the majority. And sometimes does, whether the individual represenatives of the populace like it or not.
